Terms of Use

These terms are issued by Conspicuous Revelry and are effective from June 2020. Use includes visits to our sites, purchases on our sites, participation in our database and promotions. These terms of use apply to you when you use our website. Please read these terms carefully - if you need to refer to them again they can be accessed from the link at the bottom of any page of our website.

Making a Contract with Us

When you place an order with us, you are making an offer to buy goods. We will send you an e-mail to confirm that we have received your order. Once we have checked the price and availability of the goods, we will e-mail you again to confirm that we accept your order, which indicates that a contract has been made between us. We will not take payment from you until we have accepted your order. However, upon receipt of your order, Conspicuous Revelry will create an authorisation. This will show on your bank statement as a reservation of funds which allocates the money to your order, but this will not be released until your order has been picked and processed in Conspicuous Revelry warehouse. In the event of us not being able to fulfil your order we will immediately request that your bank cancels the authorisation. In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this and what other options you have e.g substituting for a similar product or refund.

 

An order is placed on our website via adding a product to the shopping bag and proceeding through our checkout process. The checkout process includes giving us delivery and billing details for your order, entering payment information and submitting your order. The final step is the confirmation of your order, which you are able to print as a receipt of your order. We will also e-mail you with confirmation of your order. We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to be placed for commercial purposes, e.g. any kind of reseller. We also reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently, or any orders with customisation that we deem to be offensive.

Pricing

All prices listed are in NZ$. All prices are correct when published. However, we reserve the right to alter prices at any time for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order. Conspicuous Revelry is under no obligation to sell incorrectly priced goods to you at the incorrect price.
 

Errors, Inaccuracies & Omissions

Occasionally there may be information on our website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the website is inaccurate at any time without prior notice (including after you have submitted your order). Conspicuous Revelry is under no obligation to sell incorrectly priced goods to you at the incorrect price.

 

Gift Vouchers

We are pleased to sell and accept gift vouchers for purchases at our store. Vouchers have a year expiry from date of purchase. Vouchers must be redeemed in one transaction only, and only one voucher can be applied per transaction. Vouchers cannot be exchanged for cash, they can only be used to purchase products from our store. If the voucher is lost or stolen, please get in touch with us at info@conspicuousrevelry.co.nz immediately. Shipping costs are not able to be discounted through our online store, so if your voucher code covers both product and shipping cost, please get in touch with us at info@conspicuousrevelry.co.nz to place an order, including your voucher code.

Website and Credit Card Security

We take website and credit card security extremely seriously, and always endeavour to provide a secure, safe platform on which to conduct online transactions. However, we accept no responsibility for any loss or misuse of personal information provided to us through this site. We use the industry standard Secure Sockets Layer (SSL) protocol, which encrypts your information as it is transmitted over the Internet. This encryption scrambles details such as credit card number, billing details and delivery address so that generally, other computers are unable to decipher the information, ensuring privacy and security. To make sure you are accessing a secure server, check for the unbroken key or closed lock symbol located generally either at the bottom left or top right of your browser window. If it appears, then SSL is active. You can double check this by looking at the URL as well. If SSL is active, then the first characters of that line will read ‘https’ rather than just ‘http’. It is important for you to protect against unauthorized access to your password and to your computer. Ensure you logout when you have finished visiting, especially if you access from a shared computer.

 

Customisation

For any custom products, a proof will be sent before we start making your order. Please check this carefully before approving it, as once it is approved we cannot change, exchange, refund or cancel the order.

Delivery Charges

We only offer shipping through our online store to New Zealand addresses only at this time. Please contact us if you are outside of New Zealand and wish to place an order.

 

Shipping costs will be advised at checkout, and will be relevant to what you purchase. They are usually between $5 - $10, but may be more for larger/heavier items.

As most of our products are custom made, dispatch times may vary, so please allow up to 10 business days to receive your order. We expect that delivery to addresses within New Zealand will arrive within 3-5 business days of the order being dispatched. Rural delivery may take longer. You can track your order via the dispatch email confirmation. If there may be a delay in making your order, we will be in touch. If your order is urgent, please let us know and we will do our best to fulfil it as quickly as possible. 

 

If goods are lost or damaged in transit, please contact us within 7 business days at info@conspicuousrevelry.co.nz. We will use this delivery information to make a claim against the carriers. We will offer you the choice of a replacement or a full refund, once we have received confirmation from our carriers that delivery was not successful.
 

Returns

Conspicuous Revelry is dedicated to providing quality goods and services to our customers. We hope you will love what you have ordered, but if something isn't correct, please let us know.

You can cancel any item ordered online in accordance with the terms in this section apart from personalised or bespoke items unless they are faulty, damaged upon delivery or incorrect. Where you have failed to take reasonable care of the goods, we reserve the right to refuse a refund and return the goods to you at your own cost.
 
Conspicuous Revelry will accept the return of unwanted non-personalised goods within 30 days of receipt. Please contact us at info@conspicuousrevelry.co.nz to obtain details of where to send your return item/s. Please securely package and return the item/s to us in original condition, unused and with appropriate packaging. Ensure you include your packing slip as proof of purchase, and we will endeavour to replace your item/s or alternatively refund your purchase price (less postage) using the original payment method.

We will make every effort to ensure that replacement orders for delivery to addresses within New Zealand arrive within 5 business days of Conspicuous Revelry receiving the returned item/s and the order being dispatched. You cover the return postage to us, and we will cover the replacement orders postage back to you. Please ensure that you indicate clearly on the enclosed packing slip your reason for return and your preferred remedy, ie whether you would like a refund or replacement and if replacement the exact details of what you would like, including the name, size and colour as per the information for that item on our website. Unfortunately, shipping and handling charges on these returns are non-refundable. Conspicuous Revelry is not liable for the loss of items being returned. To protect yourself, you may want to use an insured service to return your goods, as these remain the property of the customer until a confirmation email is sent to acknowledge our receipt of the item/s.
 

Unfortunately we cannot accept returns for personalised or bespoke items, unless there is a fault on our behalf. Once you have placed an order with us, we will send through a proof for you to approve. Please check the proof carefully, as once you confirm the order, this will be the names or wording we will use. If there is a wording fault, some products errors can be returned and fixed for a charge if the fault was due to an oversight on your proof confirmation, or for free if the fault is on us. Please contact us at info@conspicuousrevelry.co.nz to organise what to do if this occurs.

Sale items can only be returned if they are faulty or defective.

If you receive your personalised order and genuinely do not love it, we would be sad but understand sometimes expectations do not meet reality. If this is the case, we would love to talk about how we can correct the problem. Please email info@conspicuousrevelry.co.nz if this is your scenario.

Supply Error

Conspicuous Revelry will accept the return of goods supplied in error within 30 days of receipt. Please contact us at info@conspicuourevelry.co.nz to arrange a free replacement delivery of the correct item/s, or we will refund your purchase price if out of stock.

We will make every effort to ensure that correction orders arrive within 5 business days of Conspicuous Revelry receiving the returned item/s; and the order being dispatched. Please ensure that you indicate clearly on the enclosed packing slip your reason for return and your preferred remedy. Please securely package your return item/s with supporting documentation.
 

Faulty Goods

Conspicuous Revelry will accept the return of goods delivered that are faulty within 30 days of receipt. Our quality control team inspect all deliveries to ensure the goods you receive meet our exacting quality standards. However, if you do receive a faulty or damaged item/s please contact us at info@conspicuousrevelry.co.nz to arrange a free replacement delivery, or we will refund your purchase price if out of stock.

We will make every effort to ensure that replacement orders arrive within 5 business days of Conspicuous Revelry receiving the returned item/s; and the order being dispatched. Please ensure that you indicate clearly on the enclosed packing slip your reason for return and your preferred remedy.
 

Colours

We have made every effort to portray the colour of our goods as accurately as possible. However, because the actual colours you see depend upon the monitor you view our websites from, Conspicuous Revelry cannot guarantee that your monitor's display of any colour will provide a completely accurate representation of our garment/s.

 

Intellectual Property Rights

You acknowledge and agree that all copyright, designs, trademarks and all other intellectual property and material rights relating to the Content as herein described, including all HTML and other code contained in this Site, shall remain at all times vested in Conspicuous Revelry and/or are the property of their respective owners. All such Content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorised by Conspicuous Revelry and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Violators will be prosecuted to the fullest extent permissible under applicable law. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

In addition to the Intellectual property rights mentioned above, Content is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. Conspicuous Revelry tries to ensure that the information on this site is accurate and complete. Conspicuous Revelry does not warrant or represent that Conspicuous Revelry Content is accurate, error-free or reliable or that your use of Conspicuous Revelry Content will not infringe rights of third parties. Your use of the Web Site is at your risk. Conspicuous Revelry does not warrant that the functional aspects of the Web Site or Conspicuous Revelry Content will be error free or that this Web Site, Conspicuous Revelry Content or the server that makes it available are free of viruses or other harmful components.

Social Media

We are proud of the work we do, and from time to time we may want to use photos of the final products for an order placed on our social media streams and for advertising. While we reserve the right to publish our work, we will always ask for your approval for us to post these images, as we understand you may wish to keep things private (e.g wedding sign with date etc). Likewise, if you tag us in your social media enjoying our products, we would love to share this but again will always ask for your approval and give the appropriate credit.

 

No Commercial Use

This Site is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.

Other than connecting to Conspicuous Revelry's website provider's servers by HTTP requests using a web browser, you may not gain access to Conspicuous Revelry's website provider's servers. These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.

General terms and conditions

At times, Conspicuous Revelry will run Giveaways or Competitions through our website, email newsletters and social media channels to encourage purchases and website visitation, as well as promote Conspicuous Revelry.

The following Terms and Conditions apply to all Giveaways and Competitions, in addition to any special terms and conditions, which will be published through the above channels at the time when the respective Giveaway and Competition will be promoted.

By entering a Competition or Giveaway, entrants are deemed to have read, understood and accepted the following general Terms and Conditions.

Competitions and Giveaways  

1. Competition and Giveaway prizes are given to a number of entrants selected by random draw (unless otherwise stated).

2. Entries received after a specified closing date will not be accepted. Proof of posting or emailing cannot be accepted as proof of delivery.

3. Every entrant warrants that all information submitted is true, current and complete. Conspicuous Revelry reserves the right to disqualify any entrant who does not comply with these terms and conditions.

4. Competitions and Giveaways are open to New Zealand residents, aged 18 years and over, unless otherwise stated. A person can only enter once and multiple entries will result in an entrant being disqualified.

 Entries, selection, prizes

1. All reasonable attempts will be made to contact Competition and Giveaway winners using details provided on their entry forms. Should those attempts fail, another winner will be drawn or selected.

2. Prizes are not redeemable for cash, transferable to any other person, and cannot be used in conjunction with any other offer or promotion.

3. If a prize or part of a prize becomes unavailable (for any reason), Conspicuous Revelry reserves the right to limit entry, cancel or amend the prizes at its own and sole discretion, including providing the winner with a substitute prize, either in full or in part.

4. Conspicuous Revelry’s decision is final and no correspondence will be entered into.

1. All entrants consent to participate and co-operate as required in all promotional activities relating to the Competition or Giveaway. If stated, entrants also agree to receiving emails from Conspicuous Revelry (which can be unsubscribed from at any time).

2. All information provided by the entrants will be collected, used, stored, disclosed and corrected in accordance with the Privacy Act 1993. All entrants have the right to access their information and request for any personal information to be corrected.

Conspicuous Revelry will not be liable for any loss, damage, costs (for instance incurred in accepting or redeeming a prize) or any injury whatsoever suffered by an entrant as a result of or in connection with the Competition or Giveaway, including any inability to enter, complete or continue the competition or giveaway due to equipment or technical malfunction.

3. Conspicuous Revelry reserves the right to amend or change these Terms and Conditions at any time at its sole discretion, including extending, postponing or cancelling the Competition or Giveaway.

4. These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the non-exclusive jurisdiction of the New Zealand Courts.
